Art. 1Purpose and scope

These general terms and conditions (T&C) define the terms of provision of payment gateway services offered by AUTOUR DU PAIEMENT (ADP) to merchants.

Art. 2Pricing and commissions

Classic business

Public pricing from 2.7% + €0.30 per successful transaction for classic business sectors (e-commerce, services, retail).

High-risk business

Public pricing from 4.8% + €0.55 per successful transaction for high-risk sectors (crypto, gaming, coaching, CBD).

Case-by-case pricing

The rates above are starting rates. The applicable rate is set case by case according to the merchant's risk profile (sector, volumes, dispute history, country): some businesses are charged a higher rate. The final rate is communicated to the merchant once the application is accepted, before going live, and is shown in the merchant dashboard.

Art. 3Payment terms

Funds are transferred to the merchant's bank account within a maximum of 3 business days after commission deduction. No setup, subscription or cancellation fees apply.

Art. 4Merchant obligations

The merchant undertakes to provide accurate information during registration, to comply with current regulations and to notify any changes in their business.

Art. 5Liability

ADP implements all necessary means to ensure transaction security but cannot be held responsible for indirect damages or loss of profit.

Art. 6Data protection

Personal data processing is carried out in accordance with GDPR. Data is retained only for the time necessary for legal and commercial purposes.

Art. 7Applicable law

These T&C are governed by the laws of the European Union. Disputes are subject to the jurisdiction of competent courts.

Art. 8Duration and termination

The contract is concluded for an indefinite period. Either party may terminate the contract with 30 days' notice by registered email. In case of serious violation of the T&C, ADP may suspend or terminate the account immediately.

Art. 9Chargeback fees

In case of transaction dispute by the cardholder (chargeback), a fee of €15 will be charged to the merchant to cover administrative costs. The merchant has 7 days to provide necessary evidence.

Art. 10Reserve account

For high-risk sectors, ADP may apply a retention of 5 to 10% of transactions to a reserve account for 90 days to cover potential chargebacks. Reserved funds are returned after the retention period if no dispute is pending.

Art. 11KYC and compliance

The merchant undertakes to provide all required KYC documents (ID, proof of address, business registration, articles of association) within 48 hours of registration. ADP reserves the right to request additional documents at any time and to suspend the account if not provided within the specified timeframe.

Art. 12Limitation of liability

ADP cannot be held responsible for the following indirect damages:

  • Loss of turnover or profits
  • Loss of customers or business opportunity
  • Damage to image or reputation
  • Merchant site malfunction

In any case, ADP's total liability cannot exceed the amount of commissions received over the last 6 months.
